That's what I thought, but it may just be for use of their name in the game, not their likeness to promote the service.

How dare Yahoo! use Brady's likeness. Only GQ, Vanity Fair, and Playgirl are permitted to use photos of Brady. Black and white photos of him shirtless, petting a goat.
Yahoo makes money hand over fist with this stuff and they use his image to promote their product without even paying an endorsement. It's about time these internet sites got held to the same legal branding iron that everyone else does.
Yeah, how dare he want compensation for his likeness being used without his permission. That rat bastard and his rights! Asshole! If this was anyone but Brady or one of the Mannings you guys wouldn't give a rats ass.
The claim is that the fashion in which Yahoo used his image was out of compliance with the rights they get from the NFLPA when they pay whatever rights money they pay. I don't particularly know any of the details of the contract but if Brady's camp is filing a federal complaint, I can't imagine it is an argument in the semantics of the contract.
