Don't forget that Kamara has two separate problems: (1) the criminal charges; and (2) the inevitable civil suit. At this stage, the criminal charges are Kamara's bigger and more immediate problem. If the surveillance tape backs up the victim's story and if it shows Kamara assaulting the victim, it's likely he will be prosecuted. If it's on tape and the victim's injuries are serious, it's unlikely a prosecutor will agree to drop the charges even if Kamara pays off the victim. As the Ray Rice case showed, everything changes when the incident was taped.
There's not a simple answer to that question. Damages for physical injury are not taxable. Beyond that, psychological injuries are generally taxable so if the guy was awarded money for PTSD because of the incident, that would be taxable. Punitive damages are taxable and when attorney's fees are included they are generally taxable.
